style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">The 23rd of\nSeptember marks one year since the European Commission published its proposals\nfor a new Pact on Migration and Asylum. The Pact came at a difficult time: only\ntwo weeks earlier, fires had completely destroyed the notorious Moria camp on\nLesbos, leaving 12,000 asylum-seekers homeless overnight. After carefully analysing\nthe Pact\u2019s proposal, I find this far from a \u2018fresh start\u2019. What we are looking\nat is a proposed codification and even expansion of the same deterrent and\ncontainment policies that have continuously resulted in human suffering.<\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Instead of\nworking towards meaningful solidarity and showing willingness to find a\ncompromise, EU Member States and the Council continue to erect barriers for\nasylum seekers, externalise the processing of claims and disregard fundamental\nprotection obligations. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-text-color has-greens-orange-color\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p style=\"font-size:27px\" class=\"has-text-color has-greens-orange-color\"><strong>The EU&#8217;s disastrous approach to asylum<\/strong><\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">The 12 months\nfollowing the publication of the Pact have been particularly eventful and have\npainfully highlighted the shortcomings in the EU\u2019s approach on asylum. The <strong>COVID-19 pandemic<\/strong> exacerbated the\nalready inhumane and undignified conditions faced by asylum-seekers on the\nGreek islands. Little has been done to address the acute overcrowding and lack\nof healthcare, access to adequate water, sanitation and hygiene products to\nlimit the spread of the COVID-19 in camps. Such conditions made it unrealistic\nfor people to maintain social distancing. Instead, the government\u2019s measures\nincluded strict limits on leaving camps other than for buying food and other\nnecessities, which had a significant impact on mental health. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter wp-block-image\" style=\"\"><div class=\"greens-content blk_core_image\">\n<div class=\"wp-block-image\"><figure class=\"alignright\"><img loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/09\/GettyImages-1228411369-1024x683.jpg\" alt=\"\" class=\"wp-image-8038\" srcset=\"https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/09\/GettyImages-1228411369.jpg 1024w, https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/09\/GettyImages-1228411369-300x200.jpg 300w, https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/09\/GettyImages-1228411369-768x512.jpg 768w\" sizes=\"(max-width: 706px) 89vw, (max-width: 767px) 82vw, 740px\" \/><figcaption>A migrant stands near tents as a fire burns in the Moria camp on the island of Lesbos on September 9, 2020. (Photo by Manolis LAGOUTARIS \/ AFP) (Photo by MANOLIS LAGOUTARIS\/AFP via Getty Images)<\/figcaption><\/figure><\/div>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Over this year,\nthe EU\u2019s asylum and migration policy degenerated into national efforts to\nprevent people from entering the EU and isolate them upon their arrival. <a href=\"https:\/\/www.greens-efa.eu\/en\/article\/press\/humanitarian-situation-of-refugees-and-migrants-at-the-eus-external-borders\"><strong>Ongoing reports\nof pushbacks<\/strong><\/a> through any means, including by using sound\ncannons, constructing floating walls and fences, building detention centres,\nand outsourcing asylum applications to countries far away from Europe have\nbecome the norm in several members of the European bloc. Despite a few initial\nbut shy pledges to relocate refugees from the Greek islands to other EU States,\nthe solidarity and relocation mechanism between Member States has since\ncompletely stalled. Furthermore, with the designation by Greece of Turkey as a\nsafe third country for certain nationalities of asylum-seekers, protection is\nbeing denied to a majority of those who manage to arrive, putting them in a\ndisastrous state of limbo. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Then, the <strong>Taliban takeover in Afghanistan<\/strong> again\nfocused attention on the EU\u2019s approach to asylum and migration. A <a href=\"https:\/\/www.consilium.europa.eu\/en\/meetings\/jha\/2021\/08\/31\/\">recent statement published by EU Ministers of Interior<\/a>\nis a testimony to Member States\u2019 disproportionate focus on security concerns,\ntheir disregard for taking up responsibility and the absence of clear and\nmeaningful commitments to offer Afghans the protection they need. In their\nstatement, EU Ministers have failed to offer safe and regular pathways for\nasylum-seekers to seek protection in the EU, including stepping up resettlement\npledges, issuing humanitarian visas, and opening humanitarian corridors. On 7\nOctober, Member States will participate at a High-Level Resettlement Forum on\nAfghanistan, which will demonstrate the extent of commitment Member States have\nto provide protection for those in need.&nbsp;\n<\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">In the meantime, <strong>EU funding has disproportionately served to construct closed facilities<\/strong> and <a href=\"https:\/\/www.worldfinance.com\/featured\/the-true-cost-of-the-eus-border-security-boom\"><strong>strengthen external borders<\/strong><\/a>. EU agencies and emergency funding have been mobilised to assist EU countries bordering Belarus to strengthen border control and prevent Afghan and Iraqi asylum-seekers from accessing asylum procedures. Furthermore, the EU\u2019s \u20ac38 million new multi-purpose reception and identification centre in Samos became operational this week. Despite its sports facilities, the new centre installed with military-graded fences and barbed wires, surveilled by police, and located in a remote area of the island, <a href=\"https:\/\/www.msf.org\/we-can-only-help-refugees-survive-new-camp-greek-island\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"reminds more of a prison rather than a centre to host those who seek asylum (opens in a new tab)\">reminds more of a prison rather than a centre to host those who seek asylum<\/a>. However, the current proposals do not\nprovide the solution needed to build a fair, effective and humane asylum policy\nin the EU. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">In light of the\ndevelopments at the EU\u2019s borders and beyond, and thanks to a comprehensive\nEuropean Parliament impact assessment, it has become even more clear that the\nPact\u2019s proposals are redundant and very likely ineffective in addressing migration\nrealities on the ground. Overall, the Pact\u2019s approach to asylum is diminishing\nin humanity, following the same <strong>containment\nand deterrence by suffering policy<\/strong>. It is also clear that the current set\nof proposals fail to address the challenges southern Member States face. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Despite being\nhailed as the \u201cnew\u201d Migration Pact, the Pact\u2019s proposals are based on old\nfailed ideas, including the principle of first-entry, mandatory border\nprocedures and the fiction of non-entry. Furthermore, the Pact does not propose\na way out of the current deadlock in solidarity, but rather creates further\nloopholes for Member States to avoid sharing responsibility. The new proposed\nsolidarity mechanism expands the notion of solidarity to include return\nsponsorships (i.e. financial solidarity to return asylum-seekers to third\ncountries) and capacity-building. The complexity and lack of solidarity\ncommitment in the new mechanism bears the question on whether it is workable in\npractice. Finally, it includes a proposal on mechanism for crisis and <em>force majeure<\/em>, which instead of\nintroducing new ideas of how to cope with large number of arrivals, focuses on\nderogations that will further exacerbate the already vulnerable situation of\nasylum-seekers and refugees, create additional pressure on the first-entry\nMember States, and undermine solidarity in the EU.&nbsp; <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Should the Pact\nbe implemented as it is currently proposed, we expect even more asylum-seekers\nstuck in frontline Member States, for longer periods and under even more\nrestrictive conditions. This would mean the failure to create a system that\nwould both alleviate the already existing pressure on the Member States of\nfirst-entry and provide the necessary and meaningful protection to displaced\npeople who have arrived in the EU. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-text-color has-greens-orange-color\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p style=\"font-size:27px\" class=\"has-text-color has-greens-orange-color\"><strong>Solutions for the EU Migration Pact &#8211; What needs to\nchange? <\/strong><\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\"><strong>Six years ago, the European Union descended into\nin-fighting over how to fairly distribute asylum-seekers arriving from Syria.<\/strong> Back then, officials vowed to reform the EU\u2019s asylum policy,\nparticularly the solidarity framework in the Dublin system. However, that has\nfailed, leaving Europe unprepared. As the Taliban seized Afghanistan, the EU\nwas ready to securitise its borders and make sure that the debate doesn\u2019t go as\nfar as the need to distribute asylum-seekers. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">The EU\u2019s lack of\nresponse to offer protection and dignified treatment to asylum-seekers and\nrefugees trapped in Europe and beyond are the fatal consequences of the EU\u2019s\ndeterrence and containment policy. Any reform of the Common European Asylum\nSystem must avoid replicating the failures of the so-called hotspot approach on\nthe Greek islands and avoid that people are trapped in overcrowded centres at\nthe borders and are not offered the protection needed. In the upcoming\nnegotiations on the Pact, our Group will fight for the following priorities to\nbe included: <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_list\">\n<ul class=\"has-medium-font-size\"><li><strong>Simplified procedures for manifestly well-founded claims <\/strong><\/li><\/ul>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">To provide\nbetter access and services to asylum-seekers and to reach the objective of a\nfunctioning asylum system, a simplified procedure should be introduced for the\nexamination of manifestly well-founded applications, which would be without\nprejudice to an individualised refugee status determination and the rights of\nasylum applicants guaranteed by the EU and international law. This would help\nprocess claims in an efficient and fair way, without reducing procedural\nsafeguards for people based on arbitrary factors such as recognition rates,\nwhich vary greatly between Member States and are based on questionable\nstatistics. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_list\">\n<ul class=\"has-medium-font-size\"><li><strong>Voluntary solidarity followed by solidarity by all<\/strong><\/li><\/ul>\n<\/div><\/div>\n\n<div class=\"gouter wp-block-image\" style=\"\"><div class=\"greens-content blk_core_image\">\n<div class=\"wp-block-image\"><figure class=\"alignright\"><a href=\"www.europewelcomes.org\"><img loading=\"lazy\" width=\"1024\" height=\"576\" src=\"https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/04\/migration-map3-1024x576.jpg\" alt=\"\" class=\"wp-image-6827\" srcset=\"https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/04\/migration-map3-1024x576.jpg 1024w, https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/04\/migration-map3-300x169.jpg 300w, https:\/\/www.greens-efa.eu\/dossier\/wp-content\/uploads\/2021\/04\/migration-map3-768x432.jpg 768w\" sizes=\"(max-width: 706px) 89vw, (max-width: 767px) 82vw, 740px\" \/><\/a><figcaption>The <a href=\"http:\/\/www.europewelcomes.org\">Europe Welcomes<\/a> map shows thousands of welcoming initiatives and pledges from citizens, cities and municipalities<\/figcaption><\/figure><\/div>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">In stark\ncontrast with governments\u2019 eagerness to build fences and protect borders,\nhundreds of European municipalities and cities across Europe have expressed\ntheir will and readiness to welcome asylum-seekers and refugees. Our <a href=\"https:\/\/www.europewelcomes.org\/\">\u201cEurope\nWelcomes\u201d<\/a> map and campaign shows that over 1000 cities have demanded\ntheir national governments to act and show solidarity with asylum-seekers\ntrapped on the Greek islands and beyond. We propose an immediate and automatic\nrelocation, based on first willingness of cities and regions to welcome\nrefugees, followed by mandatory relocation if necessary. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Voluntary\nsolidarity requires positive incentives which would meet the interests of host\ncountries and municipalities. The EU\u2019s funds should be used to provide\nfinancial incentives and support for municipalities and regions who receive\nasylum-seekers through the Asylum, Migration and Integration Fund and other\nfinancial instruments, including a European Integration and Development Fund.\nIf voluntary pledges fall short, solidarity by all should kick in, meaning that\nall Member States would be obliged to deliver on solidarity. Member States\nfundamentally opposed to receiving asylum seekers could instead contribute\nfinancially by covering the costs of the Member States taking asylum seekers.\nIn this way, the incentives for relocation would be co-financed by those who\noppose refugee protection in Europe for principled reasons.&nbsp; <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_list\">\n<ul class=\"has-medium-font-size\"><li><strong>On preferences of applicants<\/strong><\/li><\/ul>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">Asylum seekers\nare human beings, not numbers. Ensuring asylum-seekers&#8217; agency by taking their\npreferences and links to a particular Member States, to the greatest extent\npossible, is key for a humane and efficient asylum system. By doing so, the\nsystem will enhance their prospects of integration and reduce irregular\nmovements of asylum seekers from one Member State to another in a non-coercive\nmanner. Examples of such links include family relations, community links and\nlanguage knowledge. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-medium-font-size\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p class=\"has-medium-font-size\">The Greens\/EFA\nGroup strongly reject the idea of introducing some kind of \u2018randomizer\u2019 to\ndetermine the Member State responsible for an asylum seeker. No asylum-seeker\nshould be relocated against their will. The consent of an asylum-seeker to move\nto a Member State is crucial for respecting human dignity and preventing\nirregular movements. <\/p>\n<\/div><\/div>\n\n<div class=\"gouter has-text-color has-greens-magenta-color\" style=\"\"><div class=\"greens-content blk_core_paragraph\">\n<p style=\"font-size:27px;text-align:center\" class=\"has-text-color
