Case of Nadiya Savchenko

Greens/EFA motion for resolution

The European Parliament,

-   having regard to its previous resolutions on Russia and Ukraine, in particular its resolution on the murder of the Russian opposition leader Boris Nemtsov and the state of democracy in Russia of 12 March 2015, and on the situation in Ukraine of 15 January 2015,

-     having regard to the statement by the Vice-President of the European Commission/High Representative for Foreign Affairs and Security Policy (VP/HR) on the continued detention of Nadiya Savchenko of 4 March 2015,

-     having regard to the EU statement on Abduction and Illegal detention of Ukrainian citizens by the Russian Federation of 16 April 2015,

-     having regard to Rule 135 of its Rules of Procedure,

 A. whereas the pro-Russian militants illegally kidnapped the Ukranian pilot Nadiya Savchenko on the territory of Ukraine on 18 June 2014, detained and illegally transferred her to the Russian Federation,

B.  whereas Nadiya Savchenko was in October elected to the Verkhovna Rada and to Ukraine’s delegation to the Parliamentary Assembly of the Council of Europe; whereas the Russian Federation rejects diplomatic immunity granted to Nadiya Savchenko as a member of Verkhovna Rada, whereas the international community has undertaken numerous efforts to ensure the release of Nadiya Savchenko,

C.  Whereas on 12 February 2015 the participants of the Trilateral Contact Group consisting of the representatives of Ukraine, Russia and Special Representative of the OSCE Chairman-in-Office signed the Set of measures on implementation of the Minsk arrangements in Minsk that include the guarantee of liberation and exchange of all hostages and illegally detained persons based on all-for-all principle that was supposed to be completed no later than on the fifth day of the withdrawal of the heavy weapons,

D.  whereas Nadiya Savchenko was on numerous occasions offered amnesty under the condition that she would admit her guilt,                               

E.   whereas Nadiya Savchenko, in sign of a protest, is already more than 110 days on hunger strike, whereas during the visits, family of Nadiya Savchenko is allowed to talk only in Russian language and have restricted access to her; whereas during all the time of her imprisonment her health condition was examined only two times by German doctors and once by Ukrainian doctors; whereas on 19 February 2015 Nadiya Savchenko refused to accept any medicament support of her vital activities that poses a direct threat to her life,

F.  whereas in March a Moscow curt rejected Savechenko’s appeal for the temporary release in order for her to attend the session of the Parliamentary Assembly of the Council of Europe,

1.   Condemns the Russian Federation for the illegal kidnapping and detention of Nadiya Savchenko and demands the Russian authorities to comply in full with all the commitments in the framework of the Minsk agreements and in particular the agreed "Package of measures for the implementation of the Minsk agreements" and immediately release Nadiya Savchenko;

3.   Is of the opinion that her detention in a prison in Russia is a violation of the Geneva Convention; underlines that Russia bears a responsibility for Ms Savchenko’s fragile health; calls on Russia to allow international humanitarian organisations to have access to her;

4.   Calls for the release from illegal detention and to enroll all citizens of Ukraine, including Ukrainian director Oleh Sentsov, who were taken captive in the territory of Ukraine, transferred to the Russian Federation and are illegally kept there against their will, in the exchange of the prisoners of war;

5.   Calls for continuation of the process of exchange of the prisoners of war which was suspended by pro-Russian militants that are not ready to withdraw heavy weaponry from the contact line under control of the OSCE SMM as well as are ignoring agreements on exchange of the hostages and all illegal detainees;

6.   Urges the President of France and the Chancellor of Germany as well as the relevant Foreign Ministers to raise the question of the release of Nadiya Savchenko at the next meetings of the Contact Group on the implementation of the Minsk agreement in the Normandy format;    

7.   Instructs its President to forward this resolution to the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy, the Council, the Commission, the President, Government and Parliament of the Russian Federation, the President, Government and the Parliament of Ukraine and to the Chairman of the Parliamentary Assembly of the Council of Europe.
