EU rules on posted workers

Enforcement rules will help prevent exploitation of posted workers

A final agreement on EU legislation on the enforcement of EU rules on posted workers was reached in negotiations between the European Parliament and Council today. The Greens welcomed the outcome, with employment and social affairs spokesperson Elisabeth Schroedter stating:

"This new legislation is an important step forward for the rights of those posted to work temporarily in other EU member states. Proper enforcement of EU rules on posted workers, as agreed today, will help prevent the exploitation of posted workers and ensure they are granted their rights. Unfortunately we were not able to close all the loopholes, but the agreement reached today is nevertheless a step in the right direction.

"The 'enforcement directive' should bring an end to 'letter box companies', which are set up to enable employers to circumvent employment rules. It should also end the practise under which posted workers are forced to declare themselves self-employed, thus depriving them of basic rights. Provisions ensuring better and more frequent controls and administrative cooperation between member states will ensure posted workers' rights will be truly guaranteed."
